Scope and Terms of Use

These General Terms and Conditions (GTC) exclusively govern the contractual relationships between Coiffeur Ricci, domiciled in 8406 Winterthur, Switzerland (hereinafter “Seller”), and its customers (hereinafter “Customer” or “Buyer”) for products offered on the website www.coiffeurricci.com (hereinafter “Website,” “Internet site,” or “Online Shop,” unless otherwise stated).

These GTC exclusively govern the contractual relationship between the Seller and its customers. Conflicting or deviating terms and conditions of the customer are not recognized unless the Seller has expressly agreed to them in writing in individual cases.

Coiffeur Ricci may supplement or amend the GTC at any time at its sole discretion. The (approved) version applicable at the time the customer submits an offer shall apply.

When using our services, the customer is obligated to provide truthful and complete information during the order process. Should a customer fail to comply with this, the Seller expressly reserves the right to reject the customer’s orders. Furthermore, the Seller assumes no liability for incorrect information provided by the customer through the online shop at www.coiffeurricci.com.

The Seller generally delivers worldwide.

Subject Matter of the Contract

The subject matter of the contract consists of the goods offered and purchased by the customer through the online shop on the website.

The product images displayed on the website, particularly the colors depicted, may differ from the original product for technical reasons.

The photos on the website serve exclusively for non-binding illustrative purposes; they do not constitute a binding offer, nor can any guaranteed characteristics be derived from them.

Conclusion of Contract

When ordering in the online shop, customers can view products in detail by clicking on the product image in the product overview and place them in the shopping cart via the “Add to Cart” link. The contents of the shopping cart can be viewed at any time by clicking the “Cart” link in the top right corner of the online shop. The selected and displayed products in the shopping cart can be ordered by clicking the “Checkout” button: this takes the customer to the checkout. At the checkout, after entering the required personal data and selecting the shipping method (including providing the delivery address), the customer can submit a binding order for the selected products through the “Place Order (payment obligation)” button. By placing the order, the customer submits a binding offer to conclude a purchase contract.

After ordering the desired products, the customer receives an order confirmation via email with the relevant information. This automatically generated order confirmation email does not yet constitute acceptance of the offer but merely documents that the Seller has received the order. The Seller may therefore still decide freely whether to accept the order. Exceptionally (e.g., in case of production problems), the Seller may withdraw from the transaction even at this stage, in which case the Buyer will be informed immediately via the provided email address and the refund of the purchase price will be initiated promptly.

Acceptance of the offer and conclusion of the purchase contract occurs through a separate electronic order/shipping confirmation sent by the Seller to the customer’s email address.

The ordered product will only be shipped after receipt of payment (see payment terms below).

The Seller is entitled to withdraw from the contract even after the contract is concluded and after payment if, for any reason, the ordered goods cannot be delivered. The Seller will immediately inform the customer of the unavailability of the desired products and refund any paid amounts within 30 days. In such cases, the Seller reserves the right to offer a product of equal price and quality with the aim of concluding a new contract for the purchase of the equivalent goods.

Prices and Taxes

The prices listed for the offered products on www.coiffeurricci.com are gross prices.

Price changes and pricing errors are reserved.

Payment and Shipping Terms

The purchased goods must be paid for in advance by the customer using credit card (Master/Visa), PayPal, or G-Pay during the order process. For payment via PayPal or G-Pay, the customer is directed directly from the order process to the respective payment page and the payment is made immediately.

Shipping is carried out worldwide.

Shipping is executed only after receipt of payment by the Seller and is done at the customer’s risk.

Shipping costs: CHF 9.00 within Switzerland. For international shipping, postage may vary. Customs duties and processing fees are borne by the buyer.

The risk associated with the goods passes to the customer upon handover of the goods to the shipping company.

Shipping Time

The expected shipping time is indicated in the separate shipping confirmation sent by the Seller (information without guarantee).

If the ordered goods are not or no longer available after receipt of the customer’s order or after receipt of the order confirmation, the customer will be informed immediately.

Warranty and Liability

The absolute warranty period for asserting defects in the purchased goods is a maximum of 10 days from receipt of the product (from receipt of delivery).

Defects in the purchased product that occur during the warranty period must be reported to the Seller immediately after discovery, at the latest within 5 working days (timely notice of defects). The customer must send a written explanation of the defect and a photo of the defective condition to coiffeurricci@gmail.com.

After examining the allegedly defective product and confirming the defect, the Seller will attempt to provide the customer with a new and defect-free replacement product of the same type. The Seller covers the shipping costs for the replacement, while the customer bears the cost of returning the defective product. The defective original product must be returned to the Seller. There is, however, no guarantee of an exchange: if an identical and defect-free replacement product is no longer available, the customer will receive a voucher of equal value to the purchased item.

Any warranty is excluded if defects arise due to:

• Damage or functional defects caused by accidents, improper or abusive use, modifications, repairs, or interventions by persons lacking required professional qualifications;

• The product being washed or worn (other than normal fitting) by the customer;

• Normal wear or aging of the goods.

Any liability for indirect or consequential damages, as well as loss of the purchased product, is excluded. Coiffeur Ricci is not liable for damages caused by negligence. Coiffeur Ricci assumes no liability for transport damage caused by the postal service. Once the goods are handed over to the postal service, the risk lies with the customer.
Warranty claims for allergic reactions to material/content are fully excluded, and the product manufacturer is referenced instead.

The Seller is not responsible for error-free and/or continuously available data communication over the internet, nor for the uninterrupted availability of the online shop. She is not liable for technical and/or electronic errors occurring during an order process.

Return / Right of Withdrawal

The customer may return the received goods without giving reasons within 10 days from receipt at the delivery address by returning them to the Seller. The prerequisite is that the packaged items are either unopened and/or show no signs of use. The period begins upon receipt of the goods by the customer.

To meet the deadline, the customer must notify the return by email to coiffeurricci@gmail.com within 10 days of receiving the goods. The goods must also be returned within 10 days of receipt.

If the customer withdraws from the contract, they receive a voucher equal to the value of the returned item; cash refunds are excluded. Return shipping costs are borne by the customer.

The customer is responsible for any loss in value of the goods if this loss is due to improper handling of the goods contrary to their nature, characteristics, and functionality.

Data Protection

The data required for using the platform is treated confidentially. The Seller protects the interests and privacy of users.

Copyrights

All images displayed on the website relating to the products for sale are protected by copyright, either owned by the Seller or by the persons/companies indicated. Use of these works by third parties is permitted only with written consent from the Seller.

Final Provisions

Swiss law applies exclusively to all transactions related to these terms and conditions, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory provisions of the customer’s country of habitual residence—particularly mandatory consumer-protection laws—remain applicable where required and non-waivable.

The courts at the business location of the Seller in Switzerland shall have jurisdiction for disputes arising from this contractual relationship, unless mandatory jurisdiction applies.

Should one or more provisions of these terms and conditions be wholly or partially invalid, this does not affect the validity of the remaining provisions. The invalid or void provision shall be replaced by a legally permissible provision that most closely resembles the economic purpose of the invalid or void provision. If an invalid provision is not corrected, a corresponding statutory provision shall apply.
